These Terms of Service (“Terms”) govern your access to and use of collectibles.wiki (the “Service”).
The Service, which includes the website collectibles.wiki and Oozaruu, the Collectibles Wiki mobile app for Android and iOS (package and bundle identifier wiki.collectibles.app, published on Google Play and the App Store by YOOLK SASU), is operated by YOOLK SASU, RCS Marseille 948 155 825 (“Operator”, “we”, “us”, or “our”).
By accessing or using the Service, creating an account, submitting content, or using any registered features, you agree to be bound by these Terms. If you do not agree, do not use the Service.
collectibles.wiki is a participatory encyclopedia and personal collection-tracking service focused on collectible toys.
The Service may allow users to:
– browse toy themes and entries;
– bookmark themes and toys;
– create folders and personal collection tracking records in a registered interface; and
– submit new entries or edits for administrator review.
The Service is not an auction platform, marketplace, authentication service, legal archive, or professional appraisal service.
You must be at least 15 years old to create an account and use the Service independently in France, or older if your local law requires a higher age. If you are below the age required to use the Service independently, you may use the Service only with valid authorization from a parent or legal guardian where permitted by law.
You represent that you are legally capable of entering into these Terms.
To access certain features, you may need to create an account.
You agree to:
– provide accurate and up-to-date information;
– keep your login credentials confidential;
– be responsible for activity under your account; and
– notify us promptly if you believe your account has been compromised.
We may suspend, restrict, or terminate accounts to protect the Service, users, rights holders, or legal compliance.
You retain ownership of content you lawfully submit, subject to the license granted in these Terms and in the Community Creation Policy.
You are solely responsible for:
– your submissions;
– the folders, bookmarks, notes, or tracking records you create;
– the legality, accuracy, and provenance of your content; and
– your interactions with the Service and other users.
Personal collection folders and bookmark data are not intended to be public by default unless the Service expressly states otherwise.
You agree not to:
– submit unlawful, infringing, deceptive, abusive, or harmful content;
– use the Service to harass, impersonate, or defraud others;
– scrape, copy, mirror, or systematically extract the database or Service content without authorization;
– interfere with the security, performance, or normal operation of the Service;
– attempt unauthorized access to accounts, systems, or moderation tools;
– upload malware, spam, scripts, or malicious code; or
– use the Service in violation of applicable law or third-party rights.
Your use of the Service is also subject to the Community Creation Policy and any additional rules or notices posted on the Service.
We may review, moderate, reject, edit, unpublish, restrict, or remove content or accounts at any time, especially where we believe this is necessary for:
– legal compliance;
– protection of rights holders, users, or the Service;
– prevention of abuse, fraud, or infringement; or
– consistency, quality, or safety of the Service.
Where appropriate, we may provide a reason for significant moderation actions, but we are not required to provide detailed explanations in every case.
collectibles.wiki may contain user-submitted references to third-party names, logos, images, packaging, and other material. We do not guarantee that such content is lawful, accurate, complete, or non-infringing.
If you believe content infringes your rights or is unlawful, please send a report to: abuse@collectibles.wiki
We may act on reports by removing, disabling, restricting, preserving, or requesting clarification regarding the relevant content.
By submitting content to the Service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, adapt for technical purposes, format, publish, display, distribute, archive, and otherwise use that content as reasonably necessary to operate, improve, protect, and document the Service.
This license ends for future use when the content is deleted from the active Service, except to the extent the content has already been incorporated into backups, moderation records, legal records, or collaborative historical entries, or where continued retention is legally justified.
The Service itself, including its design, source code, structure, branding (excluding third-party brands), compilation, and original editorial elements, is owned by or licensed to the Operator and is protected by applicable intellectual property laws.
Except where expressly permitted, you may not copy, reverse engineer, redistribute, or commercially exploit the Service or its non-user-generated components.
We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice.
We do not guarantee uninterrupted availability, error-free operation, permanent storage, or continued support for any feature.
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis.
We make no warranty or representation regarding:
– accuracy, completeness, or reliability of entries, metadata, or community submissions;
– legality or provenance of user-submitted material;
– uninterrupted or secure access to the Service; or
– fitness of the Service for any particular purpose, including collecting decisions, authenticity verification, valuation, or legal compliance.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, reputation, data, goodwill, opportunities, or collection records arising out of or related to the Service.
To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service shall not exceed the greater of:
(a) EUR 100; or
(b) the amount you paid to us, if any, during the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
To the maximum extent permitted by law, you agree to indemnify and hold harmless the Operator from claims, liabilities, losses, damages, and reasonable costs arising out of or related to:
– your content;
– your breach of these Terms;
– your violation of applicable law; or
– your infringement of third-party rights.
You may stop using the Service at any time.
We may suspend or terminate your access immediately if we reasonably believe that:
– you violated these Terms or the Community Creation Policy;
– your conduct creates legal, technical, or reputational risk;
– your account is involved in infringement, abuse, or security issues; or
– termination is required for compliance or protection of the Service.
These Terms are governed by the laws of France, without regard to conflict-of-law rules, subject to any mandatory consumer protections that may apply under the law of your country of residence.
Any dispute arising out of or relating to these Terms or the Service shall be submitted to the competent courts of France, unless mandatory law provides otherwise.
We may update these Terms from time to time. The updated version will become effective when posted on the Service. Your continued use of the Service after the effective date means you accept the updated Terms.
